GENERAL INFORMATION:
All orders and purchases made through this site are subject to the "Terms and Conditions of Use" listed below. These rules may be periodically modified at the discretion of club-mate.it without notice.
The site manager is “Toletti & Olivieri G.b.R.”, hereinafter referred to as “Club-Mate-Italia”. The specifications of the products for sale presented on the site by Club-Mate-Italia are to be considered of a purely descriptive nature. Club-Mate-Italia reserves the right to make any type of change in the definition of the necessary characteristics according to the terms of the law, and the right to modify the information published, given that such modifications do not materially affect the quality and properties of the products. Club-Mate-Italia guarantees that it has the right to distribute and sell all the products offered on the site and that the products will substantially correspond to the description provided.
AVAILABILITY, PRICES AND DESCRIPTION OF PRODUCTS:
Club-Mate-Italia does not guarantee the continuous availability of the products. All products offered on the site may be periodically unavailable due to product exhaustion or other management reasons. The price of the products will be that shown on the site on the date of purchase, and includes VAT (22%) but does not include the shipping costs necessary for delivering the product to the customer, who is responsible for these costs according to the methods and costs operated on the site. All prices indicated are always to be understood in EURO (€), and must be paid in full, shipping costs included.
PURCHASE:
By pressing the "Confirm Order" button on the checkout page, the customer is guided through the automated PayPal payment procedure, up to the actual payment, upon completion of the order. Club-Mate-Italia will treat and consider this order as an offer by the customer to purchase the products offered for sale according to these terms and conditions of use, and reserves the right to refuse the order by refunding the credited amount. The customer is responsible for ensuring the correctness of the order. If Club-Mate-Italia intends to accept this purchase offer/order, Club-Mate-Italia will undertake to provide the customer with the products purchased in the quantity indicated in the order, subject to product availability.
PAYMENT:
Payment for the goods purchased and the related shipping costs can be made with any of the methods indicated on the site managed by Club-Mate-Italia at the time of purchase (PayPal and/or Credit/Debit Cards served via PayPal or simple bank transfer banking). Payment must be made before the delivery date. The shipment will be implemented only after receipt of payment by Club-Mate-Italia.
DELIVERY:
All products purchased by the customer will be shipped to the address indicated during the payment process. The customer agrees to assume the responsibility and risk of loss or damage to the goods from the moment of delivery, even if the delivery has not been received by the customer in person. Delivery dates are to be considered purely indicative. Club-Mate-Italia cannot be held responsible for any delay in delivery, as this is carried out by third-party operators.
RIGHT OF WITHDRAWAL:
Sales of products via the Internet are regulated in articles 50 to 68 ("distance contracts") of Legislative Decree 206/2005 (Consumer Code). This legislation provides the consumer with the right to withdraw from contracts or contractual proposals, guaranteeing him the right to return the purchased product and obtain reimbursement of the expense incurred.
The right of withdrawal cannot be exercised if the product is not intact, that is:
- in the absence of the original packaging;
- in case of damage;
- when the integrity of the product is no longer given.
The right of withdrawal is reserved exclusively for consumers (natural persons who purchase the goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal entities and natural persons acting for purposes related to the activity professional activity possibly carried out. The costs of returning the product are borne by the Customer.
Refund methods and times:
Club-Mate-Italia will provide the refund within 30 days from the date on which it became aware of the exercise of the right of withdrawal by the Customer. In the event that the product has already been delivered to the Customer, "Club-Mate Italia" will provide the refund following the return of the product and verification of its integrity. For purchases made via PayPal payment, the refund will be made by crediting the Customer's account.
PERSONAL DATA:
Club-Mate-Italia undertakes to use customers' personal data in accordance with the privacy regulations in force and solely for the fulfillment of the sale implemented on the site and in the exercise of its business. LIMITATION OF LIABILITY:
Club-Mate-Italia will not be held responsible or liable in any way for any damage (including without limitation economic damage such as loss of earnings or others) towards the customer if the customer does not accept these "Terms and Conditions of Use".
CHANGES TO THE “TERMS AND CONDITIONS OF USE”:
These "Terms and Conditions of Use" may be subject to modifications by Club-Mate-Italia without the need for notice and/or communication. Continued use of the site following changes constitutes a guarantee of acceptance of such changes by the user.
LEGAL NOTE:
In the event of disputes, the competent court will be that of Munich (Germany). Any dispute is placed under the exclusive jurisdiction of the Federal Republic of Germany. If any part of these "Terms and Conditions of Use" is determined to be invalid, unenforceable or outside the terms of the law, only that part will be considered invalid, while all the remaining parts will remain valid and binding.
